Website Terms

Important scope note

These Website Terms govern only your use of oftheheart.one. They are not a retreat registration agreement, lodging agreement, cancellation policy, liability waiver, medical release, or payment agreement. If registration opens, the terms governing attendance and payment will be presented separately before you commit or pay.

1. Acceptance of these terms

These Website Terms (“Terms”) govern access to and use of oftheheart.one (the “Site”), which is operated under the Of The Heart name (“Of The Heart,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Site.

You must use the Site only in compliance with applicable law. If you use the Site for an organization, you represent that you are authorized to act for that organization.

2. Informational website only

The Site introduces Of The Heart, its values, facilitators, and possible gatherings. In its current Phase 1 form, the Site does not accept registrations, applications, bookings, lodging reservations, deposits, or payments. It does not create an account or hold dates.

Site content is general information, not an offer or promise that a gathering will occur, that space or lodging will be available, or that a particular date, facilitator, activity, price, discount, itinerary, accommodation, or outcome will apply. Unconfirmed details are withheld, and published information may be corrected or changed before registration opens.

An email conversation does not by itself confirm attendance, reserve lodging, hold dates, or create a contract. A commitment exists only when the parties complete whatever separate written registration and payment process applies to that offering.

3. Separate terms for gatherings, lodging, and payment

Future participation may be governed by separate documents, which may include eligibility requirements, community agreements, informed-consent language, health and safety disclosures, lodging rules, payment terms, cancellation and refund terms, photography choices, and a participant waiver.

Those documents will be presented for review before they bind you. If a separate signed agreement conflicts with these Website Terms about a gathering, lodging, or payment, the separate agreement controls for that subject.

Heram Al Noor is a separate venue and website. Any lodging or property agreement issued by Heram Al Noor applies according to its own terms and is not replaced by these Website Terms.

4. Not medical or professional advice

The Site may discuss personal growth, heart coherence, relationships, emotional experience, community, or reflective practices. This material is educational and descriptive. It is not medical, psychological, psychiatric, legal, financial, or other professional advice, diagnosis, or treatment.

Of The Heart gatherings are not emergency services, medical care, or mental-health treatment, and they are not a substitute for care from a qualified professional. Do not delay or disregard professional advice because of something on the Site. If you believe you may be experiencing an emergency, call 911 or an appropriate local emergency service. In the United States, you may call or text 988 for the Suicide and Crisis Lifeline.

No testimonial, facilitator story, or description is a promise or guarantee of a particular result. Individual experiences vary.

5. Permitted use

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for personal, lawful, informational purposes. This permission does not transfer ownership of any content or intellectual property.

You agree not to:

  • use the Site for unlawful, fraudulent, deceptive, threatening, or abusive activity;
  • interfere with the Site’s operation, security, or availability;
  • probe, scan, or test vulnerabilities without prior written authorization;
  • bypass access controls or attempt to reach private administrative areas;
  • introduce malware or harmful code;
  • impersonate another person or misrepresent your affiliation;
  • scrape, harvest, or copy Site content at scale, except as permitted by law and ordinary search-engine indexing rules;
  • use Site content or personal information to train, build, or improve a commercial dataset or model without written permission; or
  • help another person do any of these things.

We may restrict access when reasonably necessary to protect the Site, our rights, or others.

6. Intellectual property

The Site and its original text, design, logo, graphics, photographs, video, audio, arrangement, and software are owned by Of The Heart or used with permission and are protected by applicable intellectual-property laws.

You may view the Site and share ordinary links to its public pages. You may not reproduce, republish, modify, sell, license, distribute, create derivative works from, remove rights notices from, or commercially exploit Site content without prior written permission, except where applicable law expressly permits it.

Names and logos displayed on the Site may be trademarks or service marks of their respective owners. No license to use a mark is granted by implication.

If you believe material on the Site infringes your rights, email hello@oftheheart.one with enough detail for us to identify the material and evaluate the request.

7. Third-party websites and services

The Site may link to Heram Al Noor or other third-party websites for convenience and context. We do not control those services and are not responsible for their availability, security, content, policies, or practices. Your use of a third-party service is governed by its own terms and privacy policy.

A link does not necessarily mean that Of The Heart endorses every statement, product, service, or practice on the linked site. Use appropriate judgment before providing information or entering a transaction elsewhere.

8. Accuracy, availability, and changes

We work to keep the Site useful and accurate, but content may contain errors, omissions, or outdated information. We may change, suspend, or remove Site content or functionality at any time. We do not promise that the Site will always be available, uninterrupted, secure, or error-free.

Images may depict the venue, past gatherings, or illustrative settings. Unless expressly stated, they do not promise that a particular space, room, feature, activity, or person will be part of a future gathering.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” Of The Heart disclaims warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that the Site will meet your requirements, remain uninterrupted or free of harmful components, or that every statement will be complete, current, or error-free. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Of The Heart and its owners, facilitators, personnel, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost data, loss of goodwill, or business interruption, arising from or related to your use of or inability to use the Site.

This limitation concerns the informational Site only. It does not set or limit liability under a later retreat, lodging, or payment agreement, and it does not exclude liability that applicable law does not allow to be excluded or limited.

Some jurisdictions do not allow certain liability limitations, so part of this section may not apply to you.

11. Indemnity for misuse

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Of The Heart and its owners, facilitators, personnel, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful misuse of the Site, your material violation of these Terms, or your infringement of another person’s rights.

This section does not require you to indemnify anyone for conduct for which indemnification is prohibited by law. Of The Heart may control the defense of a covered claim, and you agree to provide reasonable cooperation.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute concerning the Site will be brought in a state or federal court with lawful jurisdiction in Texas, unless the parties agree to another lawful process in writing.

Nothing in these Terms prevents either party from seeking appropriate relief in small claims court or from reporting a concern to a government agency. No arbitration agreement or class-action waiver is created by these Terms.

13. Changes to these terms

We may update these Terms when the Site, our practices, or legal requirements change. The effective date at the top identifies the current version. Changes apply prospectively when posted unless a later date is stated. Your continued use of the Site after revised Terms take effect means you accept the revised Terms.

Changes to a separate retreat, lodging, or payment agreement are governed by that agreement, not by this section.

14. General provisions

If a court finds part of these Terms unenforceable, that part will be enforced to the greatest extent permitted and the remaining provisions will stay in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a reorganization, financing, sale, or transfer of the Site or relevant business operations, subject to applicable law.

These Terms and the Privacy Policy are the entire agreement concerning use of the informational Site. They do not replace any separate written agreement for a gathering, lodging, or payment.
